Stocking and/or Conditioning seed that was not acquired with the authority of the breeder is an infringement of PBR 91, and seed processors can be liable for damages if the breeder proves there is a breach.

 

This means the Cooperative can be held liable for not only  for lost royalty revenue, but for compensation of lost markets, damages to markets and court costs as well. 

 

All Protected Varieties being conditioned for seed must:

  • Be picked up by the consignor or agent (contract trucker). Or be accompanied with the necessary paperwork to validate legal sale. 
  • Be accompanied by a signed Declaration, linked below.
